Another automobile insurance (self-inflicted) nightmare
The overwhelming likelihood is that his lady will recover nothing for her injuries. Of course this is “not fair” but it is entirely preventable. She had a choice and could have bought uninsured motorist coverage up to $1,000,000.00. This type of coverage is cheap and in fact it’s one of the best deals on the market. For probably another $100.00 to $200.00 a year in insurance premiums she would have been fully protected against this dirt bag who hit her. Instead her health benefit plan will be repaid, she will continue to suffer and she will likely see little or nothing out of this case for her pain and suffering and any out-of-pocket expenses she incurs.
Life is a series of choices.

It really depends on the state you live in. In Georgia the health care plan is only entitled to be re-imbursed IF the person injured is made fully whole. That of course, is impossible. The exception would be an ERISA plan in which the injured party doesn’t pay any type of premium, or a government funded plan such as Medicare or Medicaid. Even then, those two will work with the injured party and reduce their lien from the already minor amount they have paid. Not everyone can afford 1,000,000, in coverage, but you do need to make sure that you have as much UM coverage as you do liability. I often see people with $300,000 in liabilty and $25,000 in UM! Also, in Georgia insurance companies like State Farm and Farm Bureau write separate policies for each vehicle insured. The UM on these policies can be stacked to increase your coverage. Everyone needs to review their policy and know their coverage and make sure they talk to someone who knows insurance but doesn’t have an interest in their policy. Agents don’t tell you that UM is cheap because they don’t make any money on it.
